Kendya Goodman succeeds in Little & Anor v Olympian Homes Limited

Kendya Goodman acted for the successful applicants in Little & Anor v Olympian Homes Limited [2024] EWHC 1766 (Ch) in their applications to have statutory demands presented against them set aside and for an extension of time to make the set aside applications themselves. The debt that formed the subject matter of the statutory demands arose under personal guarantees securing a loan facility by which substantial contractual interest was allegedly owed to the respondent.

The High Court found that there existed "a genuine triable issue on the question of the existence of an operative promissory estoppel" ([135]), and accordingly ordered that the statutory demands be set aside. In so doing, the court also granted an extension of time for the applications to be made.
