Competition and Markets Authority v Michael Christopher Martin [2020] EWHC (Ch) 1751 (Ch)
In a Judgment given on 3 July 2020, ICC Judge Jones has made the first Competition Disqualification Order pursuant to s9A of the Company Directors Disqualification Act 1986.
Following the fully remote trial at which Catherine Addy QC appeared for the CMA, leading Paul Greenwood, the Judge disqualified the defendant for 7 years. Although ss9A-9E were introduced into the CDDA as part of the Enterprise Act reforms in 2003, this is the first contested case to reach trial.
