Court rules in favour of Claimants represented by Dominic Chambers QC and Benjamin John
Dominic Chambers QC and Benjamin John, instructed by David Greene, Senior Partner and Head of Group Action Litigation at Edwin Coe LLP, have won the Brexit Article 50 litigation (R (oao Miller and Santos) v The Secretary of State for Exiting the EU) in the Divisional Court. The Lord Chief Justice, the Master of the Rolls and Lord Justice Sales today ruled in favour of the two Claimants in the landmark case, holding that the Government cannot trigger Article 50 of the Treaty of Lisbon without the prior authorisation of Parliament by primary legislation. The Government has indicated it will appeal to the Supreme Court.
