The appeal in the Brexit Article 50 litigation began this morning in the Supreme Court. Dominic Chambers QC and Benjamin John, instructed by David Greene, Senior Partner and Head of Group Action Litigation at Edwin Coe LLP, represent one of the two Respondents before an unprecedented bench of all 11 Justices of the Supreme Court sitting ‘en banc’. They won judgment before the Divisional Court in the landmark case in early November. The Lord Chief Justice, the Master of the Rolls and Lord Justice Sales held that the Government cannot trigger Article 50 of the Treaty of Lisbon without the prior authorisation of Parliament by primary legislation.
