Lane v Lane [2024] EWHC 2616 (Ch)

On 21 October 2024 the High Court handed down judgment in Lane v Lane [2024] EWHC 2616 (Ch).

Following a 5-day trial, HHJ Keyser KC (sitting as a Judge of the High Court) allowed the First Claimant’s claim to disputed shares based on an oral agreement alternatively found that it would have succeeded based on a proprietary estoppel.

The Court further dismissed a petition brought by the Defendant alleging unfair prejudice arising from the company’s use of a Remuneration Trust tax scheme and rejected allegations that the director-shareholder respondents had acted in breach of their duties under s.174 Companies Act 2006. Rebecca Page appeared at trial for the successful First Claimant on the claim and First and Second Respondents on the unfair prejudice petition instructed by Bennetts Solicitors Attorneys and Notaries.
