Cross Construction Sussex Limited v Tseliki (2006)
Summary
A district judge's conclusion that there was not enough evidence to establish a connection between a debtor and the instant jurisdiction was one that he was entitled to reach on the evidence before him.
Facts
Held
A debtor's centre of main interests had to be determined at the time the court was required to consider to open the proceedings, Shierson v Vlieland-Boddy (2005) EWCA Civ 974 , (2005) 1 WLR 3966 considered. The concept of a centre of main interests meant that there could only be one such centre. While there were objective facts to establish a connection between T and the UK, equally there were other facts that pointed to a lack of connection between T personally and the UK. The district judge's conclusion was not outside the range of conclusions that he was entitled to reach on the evidence before him.
Appeal dismissed.
