Covid-19 commercial rent arrears – Cine-UK obtains permission to appeal

On 22 September 2021 the High Court granted Cine-UK permission to appeal the Order made by Master Dagnall dated 14 June 2021 in one of the leading first instance decisions on Covid-19 commercial rent arrears. Master Dagnall granted the landlord summary judgment. On the appeal, Cine-UK will be arguing that the interpretation of its lease and, in particular, the rent cesser provision was wrong as was the decision on partial failure of consideration. Significantly, the High Court has also granted Cine-Uk’s application under CPR 52.23 that the appeal should be transferred from the High Court to the Court of Appeal....

High Court judgment handed down in important shareholder dispute; Fewings v Poulter

The High Court has now handed down judgment in Fewings v Poulter, one of the largest and most important shareholder disputes to come to trial in the Chancery Division in recent years. It has been widely reported in the national media, no doubt because of its front page facts – two old schoolfriends start what later became the largest supplier of decorative stoneware in the UK and then one of them throws the other out with blackmail and extortion – but it also sets some important precedents on the law of quasi-partnerships, unfair prejudice and share valuation....
