Estate Gazette Top 10 Cases of 2021 Podcast

The Estate Gazette has released its ‘Top 10 Cases of 2021’ podcast where legal editors Sarah Jackman and Jess Harrold present their annual round-up from the courts and count down their top 10 property law cases of 2021. Listed at number 5 is the Bank of New York Mellon (International) Limited v Cine-UK Limited case in which Philomena Harrison appeared for Cine-UK. This case is going directly to the Court of Appeal in early next year (bypassing the High Court) in what is probably going to be one of most important appeals in 2022. Two New Silk Appointments for Maitland Chambers

In a Judgment handed down on Friday 17 December 2021, the Court of Appeal has confirmed that the true ratio of the Court of Appeal majority in Graham v Every [2015] 1 BCLC 41 is that there must be a causal connection between personal actions of a shareholder or third party and some other act or omission constituting conduct of the company’s affairs, for such matters to be pleaded in support of a claim for relief pursuant to section 994 of the Companies Act 2006 (unfair prejudice petition proceedings). ...
