Pickering v Hughes & Ors [2021] EWHC 1672 (Ch)

Amanda Hadkiss (led by Richard Wormald QC of 3 Raymond Buildings) represented the executor of an estate in the trial of various claims between members of a family relating to a portfolio of residential and commercial properties and certain chattels. New authority from the Patents Court on unlawful distributions by companies

A new judgment of the Patents Court in London contains an important discussion of the circumstances in which a transaction by a company will be treated as ultra vires and void as an unlawful distribution to a shareholder at common law. Meade J gave judgment on 17 June 2021 in Add2 Research & Development Ltd v dSpace Ltd and another [2021] EWHC 1630 (Pat), following a six-day remote trial in the Patents Court in London. Warner and Sony succeed in the Court of Appeal

The Court of Appeal (the Master of the Rolls, Lord Justice Arnold and Lady Justice Rose) gave judgment on 26 March 2021 in (1) Warner Music UK Limited (2) Sony Music Entertainment UK Limited v TuneIn Inc. The Court dismissed TuneIn’s appeal save in one small respect and upheld the High Court’s ruling that TuneIn infringed Warner and Sony’s copyrights through its operation of the TuneIn online internet radio service....

HMRC successfully resists appeal by Inmarsat against a ruling on capital allowances on the costs of launching six leased satellites

HMRC has been successful in the Upper Tribunal in a long-running dispute with Inmarsat concerning the launch costs in relation to six leased communications satellites which were launched between 1990 and 1996.
