Trusts & Estates

Maitland's expertise comprises the full range of non-contentious and contentious trusts work, be it for commercial or not for profit organisations, or for private clients. It includes tax planning, trusts as they arise in the context of wills and probate and litigation concerning the administration and variation of trusts.

From small domestic arrangements associated with the preservation and distribution of family wealth, to complex offshore structures created for fiscal reasons, Maitland provides advisory and drafting assistance in non-contentious issues, as well as representation at all stages of the legal process when such matters become contentious. We are often asked to act in cases where trusts and trust concepts are either utilised as a means of structuring commercial activities, or imposed by the Courts as a means to facilitate relief for wrongdoing. Our broad client base includes both UK and offshore clients, in relation to trusts established (or imposed) in this jurisdiction and abroad.

Our recent experience includes Trustees of Peter Clay's Settlement v HMRC, Gregson v HAE Trustees Ltd, Robert Cooper & ORS v Fanmailuk.com Ltd (Court of Appeal), Koonmen v Sinel Anguilla Trust Ltd (concerning the removal of a trustee of an Anguilla-based trust fund in the Supreme Court of Anguilla), and the litigation in Jersey concerning the variation of the Phi Settlement trusts.
